Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Kira mobile application, the website at kirascan.app, the Kira web scan widget, and any related services (together, the “Service”), operated by Earnzaa Retail Business Ltd, a company registered in Nigeria and trading as Kira (“Kira”, “we”, “us”, “our”).

By downloading, accessing, or using the Service, or by placing an order through it, you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service or place an order. By using the Service you confirm that you are 18 or over and that the information you provide is accurate.

3. What Kira provides

• Skin analysis. An AI-powered assessment of your skin based on photos you submit, plus personalised skincare recommendations and routines.
• Marketplace. A platform where you can buy skincare products — some sold by Kira and some by independent partner vendors — and have them delivered to you.
• Fulfilment. Orders are processed and delivered through the Earnzaa Fulfilment Centre (EFC).

Kira is not a medical device or a medical service. Our analysis and recommendations are for informational and educational purposes only and are not medical advice, diagnosis, or treatment. Always consult a qualified dermatologist or healthcare provider for any medical skin concern. Results vary from person to person and are not guaranteed.

4. Your account

• You are responsible for keeping your login details confidential and for all activity under your account.
• You agree to provide accurate, current information (including a valid phone number and delivery address for orders).
• Notify us immediately at support@kirascan.app if you suspect unauthorised use of your account.

5. Orders, prices and payment

• Currency. All prices are in Nigerian Naira (₦) and include applicable VAT (7.5%) where stated. A per-state delivery fee is shown at checkout before you confirm.
• Payment options. You may pay by Cash on Delivery (COD) or online via Paystack (card or bank). Paying online may qualify for a prepaid discount as shown at checkout.
• Order acceptance. Placing an order is an offer to buy. Your order is only accepted once we confirm it (for COD orders we may call to confirm before dispatch). We may decline or cancel an order — for example if an item is out of stock, the price was listed in error, or we suspect fraud — and will refund any prepayment.
• Pricing errors. If a product is listed at an incorrect price, we are not obliged to fulfil the order at that price and will contact you to confirm or cancel.
• Online payments are processed by Paystack under their own terms. We do not store your full card details.

6. Marketplace & partner vendors

Some products are sold by independent partner vendors, not by Kira. For those products, Kira acts as the platform and fulfilment provider that connects you with the vendor and delivers the order.

• Every product listing is reviewed before it goes live, and stock is inspected at EFC intake. We screen ingredients and reject products containing banned or harmful substances.
• Product descriptions, ingredients, and images are provided to help you choose but are not a medical endorsement. Read the product label and patch-test before full use.
• Your delivery details are shared only as needed to fulfil your order (see our Privacy Policy).

7. Delivery

Delivery timeframes, coverage, and fees are set out in our Delivery Policy, which forms part of these Terms.

8. Returns, replacements & refunds

Your rights to return items and receive refunds or replacements are set out in our Refund & Returns Policy, which forms part of these Terms. Because skincare products are personal-care items, hygiene rules apply — please read that policy.

9. Referral & partner programmes

We may offer referral rewards, points, or partner commissions. Any such rewards are subject to the rules published for that programme, are earned only on genuine, completed (delivered) purchases, and may be varied or withdrawn. Rewards have no cash value except as expressly stated, and we may withhold or reverse rewards obtained through fraud, self-dealing, or abuse. Separate agreements apply to vendors and placement partners.

10. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose;
• Submit photos of anyone other than yourself without their consent, or upload content that is unlawful or infringing;
• Attempt to interfere with, reverse-engineer, scrape, or gain unauthorised access to the Service;
• Place orders you do not intend to pay for or receive, or repeatedly refuse Cash-on-Delivery orders.

11. Intellectual property

The Service, including the Kira name and logo, software, AI models, text, and design, is owned by Earnzaa Retail Business Ltd and protected by law. We grant you a limited, personal, non-transferable licence to use the Service for its intended purpose. You may not copy, resell, or exploit any part of the Service without our written permission.

12. Your content

You retain ownership of the photos and information you submit. You grant us a licence to use them to provide the Service (for example, to generate your analysis and fulfil your orders). Photos are handled as described in our Privacy Policy, including that they are used to train our AI models only if you explicitly opt in.

13. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that the analysis or recommendations will achieve any particular result. Skincare results depend on many factors outside our control.

14. Limitation of liability

To the fullest extent permitted by Nigerian law, Kira will not be liable for indirect, incidental, or consequential losses. Nothing in these Terms excludes liability that cannot lawfully be excluded (such as for death or personal injury caused by our negligence, or for fraud). Subject to that, our total liability to you for any claim relating to an order is limited to the amount you paid for that order.

15. Indemnity

You agree to indemnify Kira against claims, losses, and costs arising from your breach of these Terms or your misuse of the Service.

16. Suspension & termination

We may suspend or close your account if you breach these Terms, misuse the Service, or engage in fraud or abuse. You may stop using the Service and delete your account at any time via Settings › Delete Account or the delete account page.

17. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, where changes are significant, notify you through the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.

18. Governing law & disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute will be subject to the jurisdiction of the courts of Lagos State. We encourage you to contact us first at support@kirascan.app so we can try to resolve any issue directly.
